DMCA / Copyright Policy

FitClips, operated by MVC Ventures, LLC ("FitClips", "we", "us"), respects the intellectual-property rights of others and expects our users to do the same. FitClips lets users import publicly available videos for their own personal fitness library. We respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (the "DMCA").

How to file a takedown notice

If you believe content available through FitClips infringes a copyright you own or control, send a written notice to the agent above that includes all of the following (DMCA §512(c)(3)):

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed.
3. Identification of the material you claim is infringing and information reasonably sufficient to let us locate it — please include the original source URL of the video (e.g. the YouTube, Instagram, or TikTok link), as that is how content is identified in FitClips.
4. Your contact information (name, address, telephone number, and email).
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

What we do with a valid notice

On receipt of a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the identified material across all user libraries and will take reasonable steps to prevent the same source URL from being re-imported. We may notify affected users of the removal.

Counter-notification

If you believe your content was removed in error or misidentification, you may send a counter-notice to the agent above containing: (a) your signature; (b) identification of the material and its prior location; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and (d) your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found), and that you will accept service of process from the complaining party.

Repeat infringers

FitClips maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. See our Terms of Service for details.

Misrepresentations

Under DMCA §512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please do not make false claims.
