Welcome to FitClips. These Terms of Service ("Terms") are a legal agreement between you and MVC Ventures, LLC, the operator of FitClips ("FitClips", "we", "us"), governing your use of the FitClips mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

FitClips lets you import publicly available videos (for example from YouTube, Instagram, and TikTok) and organize fitness clips into your personal library for your own non-commercial use. You are responsible for the links you choose to import.

2. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Subscriptions & billing

Some features require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play and are subject to their terms. Trials, renewals, and cancellations are managed through your app-store account.

4. Acceptable use

You agree not to:

• use the Service to infringe anyone's intellectual-property or other rights;
• import or distribute content you are not permitted to use;
• resell, redistribute, or publicly perform imported content;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• use the Service in violation of any applicable law or third-party platform's terms.

5. User content & imported material

Content you import remains the property of its respective rights holders. FitClips does not claim ownership of imported material. You are solely responsible for ensuring you have the right to import and use any content you add to your library. We process imported content only to provide the Service to you.

6. Copyright & DMCA

We respond to notices of alleged copyright infringement under the DMCA. To report content, or to learn how takedowns work, see our DMCA / Copyright Policy. Rights holders may contact our designated agent at info@fitclipsapp.com.

7. Repeat-infringer policy

It is FitClips' policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who infringe or repeatedly infringe the copyrights or other intellectual-property rights of others. We may remove infringing content, block the associated source links from being re-imported, and suspend or terminate accounts that are the subject of repeated valid takedown notices.

8. Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that imported content will be available, accurate, or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, neither FitClips nor MVC Ventures, LLC will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
